This Terms of Use Agreement (the “Agreement”) is a legally binding contract between Zebrax OÜ, trading as Dream Design, a company registered in Estonia (“Dream Design”), and the client, whether as an individual or on behalf of an entity (“Client”). This Agreement governs access to and use of the Dream Design website: dreamdesign.co (the “Website”), along with any related media forms, channels, mobile website, or mobile applications connected to it. Non-agreement to these terms prohibits use of the Website, and the Client must cease use immediately. However, obligations like payment for services rendered by Dream Design remain enforceable.
The Website and all content, including source code, databases, functionality, software, designs, audio, video, text, photographs, and graphics (collectively, the “Content”), and the trademarks, service marks, and logos contained therein (the “Marks”), are owned or controlled by Dream Design. They are protected under copyright, trademark, and other intellectual property laws. The Content and Marks are provided "As-Is" for personal use only and cannot be used commercially without Dream Design's express written permission.
All design and original source files created for the Client (“Projects”) are the property of the Client upon completion and payment. If, for any reason, ownership defaults to Dream Design, it is irrevocably assigned to the Client. The Client assures that all materials provided to Dream Design for inclusion in Projects are owned by the Client and do not infringe on any third-party rights. Dream Design reserves the right to publicly display design work unless otherwise specified (refer to section 18).
If any Project uses Third-Party Fonts requiring commercial licenses, Dream Design will inform the Client, detailing necessary steps for legal use.
By using the Website, the Client affirms their legal capacity to comply with these Terms of Use. The Client will not use the Website for unauthorized or illegal purposes and agrees to abide by applicable laws and regulations.
Clients shall not access or use the Website for any purpose other than that for which it is made available. The Website may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Dream Design.
Client acknowledges and agrees that any questions, comments, suggestions, ideas, feedback, or other information provided by the Client to Dream Design ("Feedback") are non-confidential and shall become the sole property of Dream Design. Dream Design shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of this Feedback for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to the Client.
Dream Design reserves the right to monitor the Website for violations of this Agreement and to take appropriate legal action, restrict access, or disable any user’s use of the Website.
By using the Website, Clients agree to be bound by Dream Design's Privacy Policy, which governs the collection, use, and sharing of personal data.
Dream Design reserves the right to determine refund eligibility on a case-by-case basis. The use of designs after a refund request may be subject to additional terms.
Dream Design reserves the right to modify or discontinue the Website or its services at any time with or without notice.
Dream Design does not guarantee that the Website will be accessible at all times and is not liable for any interruptions.
This Agreement shall be governed by the laws of Estonia.
Legal proceedings related to this Agreement shall be conducted in Estonia, and both parties consent to jurisdiction in Estonia.
The Website is provided on an as-is basis, and Dream Design disclaims all warranties related to the Website and its use.
Dream Design is not liable for any direct, indirect, incidental, or punitive damages arising from the use of the Website. Clients agree to indemnify Dream Design from all claims arising from their use of the Website.
Clients are responsible for their data transmitted or related to their use of the Website.
Clients consent to receive electronic communications from Dream Design and agree to electronic contracts, orders, and other records.
Dream Design reserves the right to share design work on digital channels, including social media and its website, unless otherwise agreed upon. Clients have the option to enter into a Non-Disclosure Agreement (NDA) with Dream Design, which would restrict Dream Design from publicly sharing or discussing the Client's work.
